The Developing Legal Framework for Defensive and Offensive Cyber Operations | Harvard National Security Journal

The Harvard National Security Law Journal has posted a speech given by former Acting Assistant Attorney General for the Office of Legal Counsel Steven G. Bradbury presented during the Journal’s March 4, 2011, Symposium, Cybersecurity: Law, Privacy, and Warfare in a Digital World. Here at Syracuse University College of Law, several students watched the symposium as a group live via webcast, then discussed it with faculty. (Video is available on the Journal’s web site at this link.)  The speech was entitled “The Developing Legal Framework for Defensive and Offensive Cyber Operations” and is available in PDF format at this link.

Perhaps as important as the article itself is the fact that Harvard’s Jack Goldsmith has labeled it on his own blog “a must-read for those interested in legal issues related to cybersecurity.”  That pretty much guarantees its inclusion in this fall’s iteration of Law 832, Cyber Security Law & Policy, here at Syracuse University, in which we also will read Goldsmith’s Who Controls the Internet? Illusions of a Borderless World (ISBN 9780195340648).
