Stuxnet = armed attack? Lawfare

Paul Rosenzweig posted a Lawfare blog entry on Stuxnet.  Specifically, Mr. Rosenzweig posted a guest essay titled “Operation Olympic Games — A Legal Setback and a Strategic Opportunity” by Ernesto J. Sanchez.

Check out the blog post for the full essay.  As a quick summary, Mr. Sanchez believes that Stuxnet’s use was inconsistent with the U.N. charter.  Specifically, Stuxnet was a unilateral use of force that probably cannot be justified by claiming “individual or collective self-defense.”  As such, Iran could bring an ICJ claim similar to the one Nicaragua brought against the U.S. in the 80’s.
